Notice on Data Transfer to Third Countries That Are Not Secure Under Data Protection Law and Transfer to US Companies That Are Not DPF-Certified

Among other things, we use tools from companies based in third countries that are not secure under data protection law, as well as US tools whose providers are not certified according to the EU-US Data Privacy Framework (DPF). For the USA, the European Commission adopted its adequacy decision on July 10, 2023. Google LLC is certified under the EU-US Data Privacy Framework. Since Google servers are distributed worldwide and a transfer to third countries (for example, to Singapore) cannot be completely ruled out, we have also concluded the EU Standard Contractual Clauses with the provider.

Storage Duration

The data sent by us and linked to cookies are automatically deleted after 14 months. The maximum lifespan of Google Analytics cookies is 2 years. Deletion of data whose retention period has been reached takes place automatically once a month.

Legal Basis

The legal basis for this data processing is your consent according to Art. 6 Para. 1 S. 1 lit. a GDPR and Section 25 Para. 1 S. 1 TDDDG.

Revocation

Use of rapidmail

Description and Purpose: We use rapidmail for sending newsletters. The provider is rapidmail GmbH, Wentzingerstraße 21, 79106 Freiburg, Germany. Among other things, rapidmail is used to organize and analyze the sending of newsletters. The data entered by you for the purpose of receiving the newsletter is stored on rapidmail’s servers in Germany. If you do not want an analysis by rapidmail, you must unsubscribe from the newsletter. For this purpose, we provide a corresponding link in every newsletter message. For the purpose of analysis, the emails sent with rapidmail contain a so-called tracking pixel that connects to rapidmail’s servers when the email is opened. In this way, it can be determined whether a newsletter message has been opened. Newsletter Sending to Existing Customers

7. Webinars and Online Meetings via Microsoft Teams

We use the tool Microsoft Teams to conduct webinars, online meetings, and video conferences (hereinafter: “Online Meetings”).

1. Responsible Party

The party responsible for data processing directly related to the conduct of Online Meetings is Peerox GmbH, Tharandter Str. 13, 01159 Dresden

Note: Insofar as you access the Microsoft website to use Microsoft Teams, the provider of Microsoft Teams is responsible for data processing.

2. What data is processed?

When using Microsoft Teams, various types of data are processed. The scope of the data depends on what information you provide before or during participation in an Online Meeting.

  • User details: Display name, email address (optional), profile picture (optional), preferred language.
  • Meeting metadata: Topic, description (optional), participant IP addresses, device/hardware information.
  • Text, audio, and video data: To enable the display of video and the playback of audio, data from the microphone and from any video camera on your terminal device will be processed for the duration of the meeting. You can switch off the camera or microphone yourself at any time via the application.
  • Chat content: If you use the chat function, the text entries you make will be processed in order to display them in the Online Meeting and, if necessary, to log them.

3. Legal Basis for Processing

We process your data on the basis of the following grounds:

  • Contract fulfillment (Art. 6 Para. 1 lit. b GDPR): If the meeting is conducted as part of a contractual relationship (e.g., a booked seminar).
  • Legitimate interest (Art. 6 Para. 1 lit. f GDPR): Our interest lies in the effective conduct of online events and communication with participants.
  • Consent (Art. 6 Para. 1 lit. a GDPR): If we record the webinar, this will only be done with your prior consent. A recording will also be technically displayed to you during the meeting.

4. Recipients / Transfer of Data

Personal data processed in connection with participation in Online Meetings is generally not passed on to third parties unless it is explicitly intended for transfer. The provider Microsoft Ireland Operations Ltd. (as a processor) necessarily receives knowledge of the above-mentioned data in order to provide the service technically.

5. Data Transfer to Third Countries

Microsoft Teams is a service provided by a U.S.-based provider. This involves the processing of personal data in a third country. We have concluded a data processing agreement with Microsoft that includes the so-called Standard Contractual Clauses. Additionally, Microsoft is certified under the EU-U.S. Data Privacy Framework, which confirms an adequate level of data protection for transfers to the USA.

6. Storage Duration

We generally delete personal data when there is no longer a requirement for further storage. In the case of online meetings, logs of chat content are usually stored for the duration of the webinar follow-up, unless legal retention obligations prevent this.
